As stated elsewhere, Minnesota is a no-fault divorce state. Affairs generally imply fault on one party but the court will not consider that aspect unless it implicates some other aspect the court properly considers. For example an affair by itself is irrelevant but if it is endangering the children of the marriage it becomes relevant. Or if the affair involves very costly gifts or expenses the innocent spouse may argue that those costs should come out of the guilty spouses' share of the marital estate.
